DATES OF PROMOTION: “DP App Download” Sweepstakes (the “Promotion”) begins at 12:00 a.m.Eastern Time (“ET”) on September 13, 2024 andends at 11:59:59 p.m. ET on September 30, 2024(“Promotion Period”). Website (defined below) clock is the officialclock of the Promotion. Normal Internet, phone and usage charges imposed byyour online or phone service provider may apply.
ELIGIBILITY: The Promotion is open only to legal residents of one of the forty-eight(48) contiguous United States or the District of Columbia who are eighteen (18)years of age or older or the age of majority in their state of residence as ofthe date of entry (the “Entrant”). Employees, officers and directors of Sponsor and each of itssubsidiaries and affiliates, distributors, vendors, advertising/promotionagencies, and any others engaged in the development, production, execution ordistribution of the Promotion, including, but not limited to, NationalSweepstakes Company, LLC (the “Independent Administrator”), and the entitiessupplying the Grand Prize (collectively referred to herein as “PromotionEntities”) as well as their immediate family members (spouses, siblings,children and parents, regardless of where they live) or members of the samehouseholds (whether related or not) of such employees, officers and directorsare not eligible to participate. All federal,state and local laws and regulations apply. Promotion is void outside of theforty-eight (48) contiguous United States, the District of Columbia andwherever else prohibited or restricted by law.
By entering the Promotion, Entrant indicates their full andunconditional agreement to, and acceptance of, these Official Rules and thedecision of the Sponsor, which are final and binding in all respects. Winning aprize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: This Promotion has; (a) an initial entry method (“Initial Entry”); and(b) bonus entry methods (each, a “Bonus Entry”). All Entrants must first enter via the InitialEntry method prior to receiving Bonus Entries.
1. Initial Entry
a. App Download:Download the Dude Perfect App (the “App”) and complete the profile in itsentirety to receive one (1) entry into the Promotion. The App can bedownloaded using IOS or Android. The App is free to download. Partial or incomplete downloads will not beaccepted.
2. Bonus Entry
a. Watch Time: Entrants may receive one (1) additional entry for each one(1) hour of watch time in the App. For example, if an Entrant 5.35 hours ofwatch time in the App during the Promotion Period, they would receive five (5)additional entries for a total of six (6) entries (1 for the App Download and 5for the watch time). Watch time entries willbe calculated based on an approximation of watch time estimated from theheartbeat reported by the apps.
b. Mail-in: To enter the Promotion without watchtime, Entrant may enter by mail as follows: on a plain 3” x 5” card, legiblyhandprint or type your first name, last name, complete address, city, state,zip code, and email address (if any) and mail your completed 3” x 5” card in a#10 envelope to: “DP App Download”Sweepstakes, PO Box 428, Newark, NY 14513. Each envelope shall equalone (1) entry. Entries must bepostmarked by September 30, 2024 and received by October 7, 2024 to be eligiblefor the drawing. Multiple entries submitted in the same envelope are void. Entries submitted or completed by anyoneother than the Entrant are void. No mechanical reproductions will be accepted.Sponsor will not verify receipt of entries for Entrants. All entries submitted become the soleproperty of Sponsor and will not be returned. Sponsor is not responsible forlost, late, misdirected, illegible, damaged or postage due mail-in entries.
Regardless of the entry method, there is a limit of fifty-one (51)entries per Entrant for the entire Promotion Period.
Normal Internet access and usage charges imposed by Entrantsonline service will apply. If Entrant participates
from a mobile phone, such activity will be subject to thecharges pursuant to their wireless service provider’s rate
plan. Entrant further understands that by participating viamobile phone, if they are a potential prize winner, the
Sponsor may contact them via mobile phone, which will besubject to the charges pursuant to their wireless service
provider’s rate plan. Please consult wireless serviceprovider for more information. Entrants are solely responsible
for any related equipment and Internet access charges, ifany.
Neither Sponsor nor any other Promotion Entities are responsible for anyentry that is lost, late, misdirected or undeliverable, whether due to systemerrors, omissions, interruption, deletions, defects, delay in operations ortransmissions or any other reason, theft or destruction or failures, faultytransmissions or other telecommunications malfunctions, entries not receivedresulting from any hardware or software failures of any kind, lost orunavailable network connections, failed, incomplete or garbled computer ortelephone transmissions, typographical or system errors and failures, faultytransmissions, technical malfunctions, or otherwise.
In the event of a dispute regarding the identity of the personsubmitting an entry, the entry will be deemed submitted by the authorizedaccount holder of the e-mail address submitted at the time of entry. Theauthorized account holder is the natural person who is assigned to the e-mailaddress by an Internet access provider, on-line service provider, or otherorganization that is responsible for assigning e-mail addresses, or the domainassociated with the submitted e-mail address. Potential Grand Prize Winner(defined below) may be required to show proof of being the authorized accountholder.
Any attempt by an Entrant to obtain more than the allowable number ofentries by using multiple/different email addresses, accounts, identities,registrations, logins, and/or any other methods, including, but not limited to,automated entry, will void all of that Entrant’s entries and that Entrant maybe disqualified from the Promotion. Multiple Entrants are not permitted toshare the same email address or accounts. Neither the Sponsor nor any PromotionEntity will verify receipt of entries for Entrants. All entries submittedbecome the sole property of Sponsor and will not be returned.
Without limitation, Sponsor reserves the right in its sole discretion todisqualify any Entrant whose social media account that, in their sole opinion,refers, depicts or in any way reflects negatively upon the Sponsor, thePromotion or any other person or entity; does not comply with these OfficialRules; or if Sponsor receives notification about any potential infringements orbreaches of law or any other reason set forth herein.
DRAWING/ODDS: On or about October 9, 2024, one (1) grand prize winner (the“Grand Prize Winner”) will be selected at random from among all eligibleentries received during the Promotion Period. Odds of winning depend upon thetotal number of eligible entries received during the Promotion Period. Therandom drawing will be conducted by a Sponsor representative, whose decisionsare based on its sole discretion and interpretation of these Official Rules,and are final and binding in all respects.
GRAND PRIZE: Grand Prize Winner will receive is $20,000 cash to be awarded in the form of a check (“Grand Prize”). Total approximate retail value of the Grand Prize is $20,000.
GRAND PRIZERESTRICTIONS: No transfer or substitution of theGrand Prize is allowed except at the sole discretion of the Sponsor. GrandPrize Winner is required to comply with any and all applicable federal, state,and local laws, rules and regulations. The value of the Grand Prize is taxableas income and the Grand Prize Winner is solely responsible for all mattersrelating to the Grand Prize, including, but not limited to all applicablefederal, state, and local taxes that become due with respect to the GrandPrize. Sponsor reserves the right to substitute a prize of equal or greatervalue if any part of the Grand Prize becomes unavailable due to reasons beyondthe control of the Sponsor. Sponsor will not replace any lost or stolen portionof the Grand Prize. No more than the one(1) Grand Prize as set forth in these Official Rules will be awarded.
GRAND PRIZENOTIFICATION: Potential Grand Prize Winner will benotified via e-mail or mail within two (2) business days of the date in whichthe potential Grand Prize Winner is selected (the “Notification”). In order toclaim the Grand Prize, the potential Grand Prize Winner must respond to theNotification within the time frame indicated by providing the RequiredDocuments (as defined in the “GRAND PRIZE CLAIMS” section below). In the eventthat: (a) the potential Grand Prize Winner fails to respond to theNotification; (b) the potential Grand Prize Winner fails to supply the RequiredDocuments; (c) any Notification is returned as undeliverable; and/or (d) it isdetermined by the Sponsor, in its sole discretion, that the potential GrandPrize Winner is not eligible in accordance with these Official Rules, suchpotential Grand Prize Winner will be disqualified and an alternate Grand PrizeWinner will be selected at random from among all remaining non-winning eligibleentries received during the Promotion Period.
GRAND PRIZECLAIM: Except where prohibited, the potential Grand Prize Winnermust sign and return to the Independent Administrator an affidavit ofeligibility/release of liability/publicity release (the “Release”) and IRS formW-9 in order to claim the Grand Prize (collectively, the “Required Documents”)within the time frame indicated in the Notification. If the potential Grand Prize Winner fails tosign and return the Required Documents within the required time period, the potential Grand Prize Winner forfeits their right tothe Grand Prize and an alternate Grand Prize Winner will be selected at randomfrom among all remaining non-winning eligible entries received during thePromotion Period. The Grand Prize Winner consents to use of their name, likeness,biographical information, and voice (or any derivation thereof) in advertisingworldwide without additional compensation (TN residents will not be required tosign a publicity release as a condition of winning the Grand Prize). The GrandPrize is taxable as income and the Grand Prize Winner is solely responsible forany taxes on the Grand Prize, including, but not limited to all applicablefederal, state and local taxes. TheIndependent Administrator must report the value of the Grand Prize to the IRSin the year the Grand Prize is received by the Grand Prize Winner and will bereported to the Grand Prize Winner and the IRS in the form of a Form 1099.
GENERAL: All federal, state,and local taxes on the Grand Prize are the sole responsibility of the GrandPrize Winner, if applicable. Byparticipating in this Promotion, each Entrant agrees to abide by and be boundby these Official Rules and the decisions of the Sponsor and IndependentAdministrator which shall be final in all respects relating to the Promotion,including without limitation the interpretation of these Official Rules. Sponsor, its licensees, subsidiaries,affiliates, advertising agencies, promotional agencies and suppliers and anyother individual or company involved in the development or execution of thePromotion, including the Independent Administrator, and each of theirrespective directors, officers, shareholders and employees are not responsibleand shall not be liable for; [a] electronic transmission errors resulting inomission, interruption, deletion, defect, delay in operations or transmission,theft or destruction; [b] unauthorized access to or alterations of entrymaterials; [c] technical, network, telephone equipment, electronic, computer,hardware or software malfunctions; or [d] limitations of any kind or inaccuratetransmissions of or failure to receive information by Sponsor on account oftechnical problems or traffic congestion on the Internet or at any website orany combination thereof. Sponsor and / or Independent Administrator are notresponsible for lost, late, incomplete, incorrect, damaged, misdirected, orillegible entries or any condition caused by events beyond the control of theSponsor that may cause the Promotion to be disrupted or corrupted. Sponsor may prohibit an Entrant fromparticipating in the Promotion or winning the Grand Prize if, in its solediscretion, it determines that said Entrant is attempting to undermine thelegitimate operation of the Promotion by cheating, deception, or other unfairplaying practices or intending to annoy, abuse, threaten or harass any otherEntrants, Sponsor, or Independent Administrator. Entries which contain false information, areincomplete, inaccurate or are otherwise forged, defective, or made outsideauthorized channels, including those which have failed due to malfunction orfailure of phones, phone lines, telephone systems or networks, server,providers, computer equipment, software or any combination thereof of any kind,any human error or otherwise, shall be void. CAUTION:ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATEOPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULDSUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES ANDDAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENTOF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCEANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSISTIUTE A WAIVER OF THESEPROVISIONS. If, for any reasonwhatsoever, this Promotion, in Sponsor’s sole opinion, is not capable ofrunning as planned, including, but not limited to, by reason of infection bycomputer virus, tampering, fraud, technical failures, or any other cause which,in the Sponsor’s sole judgment, corrupts or affects the administration,security, fairness, integrity or proper conduct of this Promotion, Sponsorreserves the right at its sole discretion to cancel, terminate, modify orsuspend this Promotion and limit entries to those submitted prior to the actiontaken, or to proceed in such a manner as may be deemed fair and equitable bySponsor in its sole discretion. Notice of such action will be posted on the Website.All federal, state, provincial and local regulations apply.
DISPUTES: ENTRANTS AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMSAND/OR CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION OR THEGRAND PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORMOF CLASS ACTION AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK IN ASTATE OR FEDERAL COURT LOCATED IN NEW YORK, NY WITHOUT REGARD TO PRINCIPLES OFCONFLICTS OF LAW; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITEDTO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITHENTERING THIS PROMOTION, IF ANY, BUT IN NO EVENT WILL ENTRANT BE ENTITLED TORECEIVE ATTORNEYS’ FEES OR BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY,INCIDENTAL OR CONSEQUENTIAL DAMAGES.
NO LIABILITY: By participating, Entrants agree to release, discharge, indemnify andhold harmless the Sponsor and each and all of the Promotion Entities from andagainst any claims made by the Grand Prize Winner, Entrants, or any other thirdparties, related in any way to the operation of the Promotion as well as anyother claims, damages or liability due to any injuries, damages or losses toany person (including death) or property of any kind resulting in whole or inpart, directly or indirectly, from acceptance, possession, misuse or use of anyprize or participation in any Promotion-related activity, in the Promotion orany claims based on publicity rights, defamation or invasion of privacy ormerchandise delivery.
INFORMATION/PRIVACYPOLICY: By entering the Promotion, eachEntrant consents to the collection, use and distribution of his or her personalinformation by the Sponsor for the purposes of implementing, administering andfulfilling this Promotion and, if consent is given at the time of entry.
